Licensing Questions

[1)Is it common for a company to inquire if your product is patent pending based on a provisional application opposed to a Utility patent (after they recieve sell sheet etc.)?Or do they care?

2)Are they discouraged by the fact that there is a possibility that you(some inventors) have not done a proper patent search and that the product idea that you are pitching may already be on the market?

3)Do most companies ask for additional information like your patent search findings or are they just willing to do this if you have presented them with a product that can make them a good profit?

4)What are some additional questions that a company might ask you after they have recieved your sell sheet,manufacturing considerations/costs?

A: Companies will ask about any type of protection you have on your idea, if you have a patent, etc. They want to know if they are interested in your product what will keep the competitors at bay. Plus, they want to know if you have already paid for it or if they will have too.

A: Yes. You need to do as thorrough a search as possible to know what is out there otherwise you are wasting their time and yours.

A: They would be more receptive if you have done this search. They will do their own to protect any investment if they are interested.

4)What are some additional questions that a company might ask you after they have recieved your sell sheet,manufacturing considerations/costs?

A: Do you have a prototype? Who are your competitors? What is the wholesale cost? Are you wanting to license it or manufacture it? Do you have any outlets for your product? What type of patent do you have, design, utilitiy, etc? What percentage of royalty are you looking for? Are you the sole Inventor? If you have a patent when was it issued? What are the products benefits?

This question concerns the patent search, when you hire a patent attorney, dont they usually do the patent search for you?
the only search i have done was to search google, i searched it in various way like prototype, new invention, new design, etc

Yes, you can hire a patent attorney to do the search for you. If you plan on doing a search first yourself you need to search the patent offices website and you can use google.com/patent.
Before you hire someone to do it for you do a search yourself first. You will be surprised how many you will find on your own. I have people send me inventions they swear are not on the market because they looked. It is amazing how quickly I will find it by just putting in a simple word search in Google.com I have not even tried going to the patent office yet. Looking yourself first can save you hundreds of dollars and wasted time.

Patent attorneys usally dont do extensive searches from my experiences with them. It takes hours to really dig into patents. Plus they dont search the web deep enough for simular products.There expertise is in writing the description and claims.

I remember one time yrs ago I was in my patent attorneys (Tom) office going over one of my ideas with him. He left the room to make some copys and I notice a prototype on his desk that interested me. When he came back in the room I had the prototype in my hand and asked him about it. He told me the prototype was invented and made by a greenhorn inventor. The thing was pretty cool and unique. I thought it had tons of potential and so did Tom.
After I got home that prototype was still on my mind,so I fired up my computer and started a patent search on my own. Within 20 mins I located a patent "application" that was published 3months before the inventor went to see Tom. It was the exact idea to a T.

Theres skill and luck involved in product or patent searching. Practice,practice and more practice is the name of the game. Ive talked to Roger many times about this issue, both of us get inventors that contact us on a regular basis that swear there ideas new and unique. We do a quick search and find it within mins most of the time. I think most greenhorn inventors see $$$$ signs way to early in the game and dont put in enough product research, next thing there o the phone with some patent attorney want to file a patent app......Big mistake,,,, Ive been there done that yrs ago. Never again !!!!
