Taking the potential situation your suggesting as an example, the only way you'll know and still be able to establish priority for your own patent application (assuming that whoever would try to pull some stunt would also avoid telling you about it) is if/when both applications get examined by the USPTO. This would likely initiate an interference proceeding.

If you're really concerned, you'll want to follow up with a non-provisional sooner than later. This will increase the chance that you will have seniority in the interference, which is a distinct advantage. But, a situation where someone tried to steal your idea thru the USPTO is extremely unlikely, and you'd still be able to prevail as the junior applicant.

The other way to find out is if/when you see your product on the market.

My name is Cynthia Bates. I work for a legal review site site called LegalSpring.com.

We host <a href="http://www.legalspring.com/Site.aspx?site=1&sitename=LegalZoom">LegalZoom reviews</a>, and I would VERY MUCH appreciate your feedback on LegalZoom!

I see that a few people here have had a bad experience with LZ. Well, we get mostly positive reviews from their users - so I want to hear the other side of the story. Perhaps LZ is good at the business formations and Wills, but not patents?

Thank you so much for your time - I hope to hear from a couple of people in this forum about their LZ experience! I think it will help others who are searching on info about this company...

Legal Zoom 24Hr Patent Use PatentMatch.com they are real

I have been inventing things for 30 years. Once I discovered I could file a provisional patent I started using that to protect my new inventions.

I tried Legal Zoom and by the time I was done it Cost $480. They use a low teaser rate in their Ads much less then this. It took 3 months to get a patent pending number and receipt of the filing. They were constantly trying to get me to buy an expensive search and expensive drawings. Also they had some kind of patent review for $800.

When I would call LegalZoom.com the customer service was just horrible.

I tired 24hrpatent.com and things got much worse. They do not really have anyone there. This must be some kind of web site front for a non patent attorney business. There was no patent attorneys or patent experts. I asked to have the name of my patent attorney and they said they do not do that, this was emailed to me. Emails sent to them would get a response days or weeks later. The 24 hour turn around time turned out to be 2 weeks. I wonder what they actually sent in because they would not provide that when I asked.

So again I searched for a provisional filing service that was reputable. I found PatentMatch.com This is a Real Patent Attorney. He filed my provisional patent within 2 hours of submitting the documents to the web site. I was provided with all the documents and filing receipt from the US patent office showing this was all done within 2 hours. I called the 800 TOLL FREE number making sure this was a real person and the patent attorney answered the phone and spoke with me for at least an hour without a fee. Also I tired the chat online on the web site to ask some quick questions and it worked great.

For $79 plus the $105 US filing fee I had an actual provisional patent filed by a patent attorney from PatentMatch.com.

Also patentmatch.com will help with the regular non provisional patent application and licensing later on.

Normally, when someone new joins in and makes a first and usually only post extolling the virtues of a company or site, we usually delete it as spam.

Really don't want to be unfriendly so I'd love to learn some more about you and you invention background?

As you know i posted earlier saluting 24hrpatent.com for their speed and price. I have since read a few complaints about them not responding to submissions.

I talked directly to their product placement people who gave some insight I thought I would share. She told me that if they get a request from someone who they did not file the patent for it gets little attention as they are swamped with existing clients.

I told her they should charge for the service to reduce the numbers. she explained that they do not charge because only about 10% of all products get placed or bought.

So... i guess beware if you send them a submission and you are not one of their clients!

SIDEBAR... I am heading to the big NACDS show in California this summer to peddle my goods to drug stores! It is a great show for all you fellow inventors

Captain, that made me laugh so unexpectedly that I spit coffee on my monitor (copyright 2007 Road Show).

The bottom line with all of those special deals for provisional patent filings is, there's no point in doing it, if you're not sure it's comprehensive enough. I mean, that's not tough to do, in many cases. But, those companies like LegalZoom, and all the rest, who offer rates of $100-300...they don't review your material for content or merit. They don't reference patent law to even help YOU prepare a solid application, one that will withstand a challenge to priority thru litigation, much later on. They just take your work and forward it, knowing that they will never have to answer for it.

You may as well just do it yourself, thru the USTPO website, and spend less money. All you need is the PPA coversheet form (SB16).

In my opinion, to offer a service of forwarding material and charging a fee to make it seem as if they will be establishing protection for the customer, is not much different than a scam.

Sorry about the coffee..

I appreciate your position, but I think the guys over at 24hrpatent are a quite a bit different than Legalzoom. I did a provisional and utility with them and actually met one of their attorneys at a tradeshow in Dallas.

I learned a little bit about how they do it so fast and cheap. Apparently, at least the guy I ran into, contracts out to them for a set price. He says he moonlights for them as do some of his colleagues. So, they are farming it out. Outsourcing is getting out of control!

I do agree that a lot of these guys like Legalzoom and several others offer offer little to nothing for your money.
